Get ’em, Boies: Salesforce Countersues Microsoft

Salesforce.com CEO Marc Benioff says Microsoft is a patent troll. Looks like it takes one to know one. On Thursday, the company answered Microsoft’s charges of patent infringement with patent-infringement charges of its own.

In a suit filed in U.S. District Court in Delaware, Salesforce accuses Microsoft of willfully violating five of its patents and using them in everything from Windows 7 to the Windows Live authentication system. And the company is really going for the neck here: Not only is it seeking triple monetary damages, it has hired David Boies, the former U.S. Justice Department attorney who successfully argued the agency’s antitrust case against Microsoft, to represent it.

But if Microsoft (MSFT) finds this disconcerting, the company isn’t letting on. Reached for comment, Horacio Gutierrez, vice president and deputy general counsel, said it’s still intent on taking Salesforce (CRM) to the mat over this. “We are reviewing Salesforce.com’s filing, which we have just received,” he said. “We remain confident about our position and will continue to press ahead with the complaint we initiated in the U.S. District Court for the Western District of Washington.”

EBay Now Equipped With Frickin’ RedLasers

EBay CEO John Donahoe says that a few years from now we’ll be making more purchases with our cellphones than from our wallets. And the company’s sales do seem to bear that out. At our D8 conference, Donahoe said eBay’s (EBAY) iPhone app was responsible for $600 million in sales last year. So the company’s acquisition today of RedLaser makes good sense.

The mobile barcode-scanning application has proven a big hit with savvy shoppers who use it for on-the-spot comparative pricing information, snapping photos of barcodes, which the application uses to discover additional information about the product as well as prices from other merchants. Now that eBay owns it, a lot of that information will be pulled from its own listings and retail partners.

When it debuted on Apple’s (AAPL) iTunes App Store, RedLaser was priced at $2. But beginning today, eBay is offering it for free, and soon it will integrate RedLaser’s barcode scanning tech into its current iPhone applications.

Terms of the deal were not disclosed.

Underpromise and Early Deliver: Apple Says Some iPhone 4 Pre-Orders Coming Tomorrow

Here’s a nice surprise for early adopters who managed to successfully place an iPhone 4 order on the first day it was possible to do so: Some of you may receive your device a day early. According to an email notification from Apple (AAPL) to some pre-order customers, iPhone 4 delivery “will occur on June 23rd.” That’s tomorrow, not the originally promised delivery date of June 24.

Dear Apple Store Customer,

You recently received a Shipment Notification email from Apple advising you that your iPhone has shipped.

This email is to confirm that your delivery will occur on June 23rd. Although Apple and FedEx tracking information may currently indicate a later date, you can check the FedEx website the morning of the June 23rd to track your package to your doorstep.

In the event that you will not be available to accept delivery on June 23rd, it may be more convenient to use our pre-sign delivery option by visiting our Order Status website at http://www.apple.com/orderstatus.

Sincerely,

The Apple Store Team

The reason for the change in delivery date isn’t clear, though it might be that Apple is hoping to protect its servers from meltdown by staggering initial iPhone activations over two days.

New Zune2 review (part 2-1) upgrade, hardware, software and Social

When we first caught wind that Microsoft was in fact doing its own portable media player (and then published the first ever photo of the Zune), we hoped it might finally be the play to knock the iPod off its perch. Sure, in mid 2006 there was no shortage of devices more advanced than any given iPod, but then (and now) the iPod enjoyed unchecked dominance of the market in the US and many countries abroad. Steve Jobs knew the day would come that Microsoft would really enter the game.
What we were hoping for was that the portable media world might be in store for another Sony / Nintendo upset. Remember in the 90s how Sony and Nintendo's partnership went awry, and Sony, totally sick of Nintendo completely owning the game console space, brought out the original PlayStation? Before the console's second generation was through Sony had more market share than they knew what to do with. Sony upped Nintendo's game with the PlayStation, then upped their own with the PlayStation 2 -- and took over.
If Sony could do the impossible and topple the infallible Nintendo of old, surely Microsoft, the world's largest technology company, could make at least make a dent in Apple's armor. Yeah, the first-gen product is important, but the second gen product is crucial, because if you can't up your game -- and everyone else's -- you're just another player. This year, Microsoft really had to make the Zune count. Read on to judge for yourself whether they did.
The first generation Zune, as we all know, was little more than a slew of off the shelf hardware and software Microsoft cobbled together in a rush to make a play for the annual holiday gold rush. And the interesting part is, all things considered, it really wasn't bad at all. No one thought it was "done", but it was a lot better than some of the other PMC-based devices we'd seen to date. This year Microsoft brought a slew of new Zune products (and enhancements) to the table, including two new players (flagship 80GB and the flash model), new device software (which runs on all devices), new desktop software, and a new service (Zune Social, a music-oriented social network reminiscent of Xbox Live).

The first generation Zune

Device software
Yeah, we know Microsoft technically skipped right past device software v2.0 and jumped to 2.2, but the update is the best place to start since it affects the most users and devices. Microsoft won some well-deserved brownie points for ensuring all Zune players new and old can run the new firmware, meaning that for now your old Zune will have feature parity with the new hardware.
So here's the deal with the device software: it adds some crucial bits (many of which we expected the first time), takes away some minor but important things, and leaves the other 90% largely unchanged. First, the stuff Zune 2.0 takes away:
Song flagging
The five star rating system
The language menu The good stuff, though, is very good:
MPEG-4 and H.264 playback support
Podcasting support
Sync over WiFi (which we'll get to later)
In terms of performance, both old and new hardware and firmware were almost identical in testing. A lot of people have been claiming the new firmware is much snappier, but we didn't find that to be true at all. Two Zune 30 devices boot up within a half second between 1.0 and 2.0 series firmwares, and the flash-based Zune 8 we tested booted to home screen less than a second faster. Traversing menus took no more or less time or when syncing and the like. (Note: scrolling through long lists appears to happen slightly faster, but that's likelier an interface tweak, not a performance increase.)

Apple Gives iOS Developers a Little More Language Leeway

Apple has quietly updated the iOS Developer Program License Agreement, relaxing a restriction on interpreted code that has effectively kept Adobe’s Flash platform off the iPhone–but not enough to allow it on.

When Apple (AAPL) last updated the agreement, in April, the following text was added to section 3.3.2.

No interpreted code may be downloaded or used in an Application except for code that is interpreted and run by Apple’s Documented APIs and built-in interpreter(s).

This text banned cross-compilers like Adobe’s (ADBE) Flash-to-iPhone utility, which would have allowed apps written in Flash to run on the iPhone. But the change also seemed to restrict the use of interpreted languages like Lua, which figure prominently in games like Tap Tap Revenge. Now Apple has tweaked the restriction, adjusting it to permit the use of interpreted code, provided it is used only for minor features and with Apple’s written consent. Here’s the updated text:

Unless otherwise approved by Apple in writing, no interpreted code may be downloaded or used in an Application except for code that is interpreted and run by Apple’s Documented APIs and built-in interpreter(s). Notwithstanding the foregoing, with Apple’s prior written consent, an Application may use embedded interpreted code in a limited way if such use is solely for providing minor features or functionality that are consistent with the intended and advertised purpose of the Application.

So, a small change but a significant one. Cross-compilers, Flash and middleware platforms are still forbidden, but–with Apple’s explicit blessing–popular game engines or libraries like Lua and Unity 3D are not.

Verizon to Debut Next-Gen Droid on Eve of iPhone 4 Launch

What an astonishing coincidence.

Motorola and Verizon Wireless have set a date for the debut of their next-generation Droid device: Wednesday, June 23, one day prior to the street date for release of Apple’s iPhone 4. Presiding over the launch: Verizon Wireless marketing chief John Stratton, Google (GOOG) VP of engineering Andy Rubin, Motorola co-CEO Sanjay Jha, and–more interestingly–Adobe (ADBE) CEO Shantanu “Thoughts on Flash” Narayen (see invitation above; click to enlarge).

A bold move. But a potentially foolish one as well. If this year’s iPhone launch week is anything like those of years past, Apple (AAPL) will be sucking so much air out of the news cycle there may be little left for Verizon (VZ) and Motorola (MOT), even if this latest Droid is as promising as it sounds.

FBI Opens Probe of iPad Breach

The Federal Bureau of Investigation has opened an investigation into the security breach in AT&T Inc.’s (T) website that exposed the email addresses of some iPad owners.

“The FBI is aware of these possible computer intrusions and has opened an investigation,” said Katherine Schweit, an FBI spokeswoman. Ms. Schweit said the FBI opened the investigation Thursday but it will not comment on what it is looking at. “It’s very early in the investigation,” she said.

AT&T, the sole U.S. provider of wireless service for the Apple Inc. (AAPL) tablets, acknowledged Wednesday that a security flaw in its website made it possible for iPad users’ email addresses to be exposed.

Some problems the new iPod touch users may meet

1. How to change iTunes to recognize the new iPod touch
Some New iPod users may meet the situation that your iTunes can not detect your new iPod nano, iPod touch, or iPod Classic. It should recognize it immediately. If it doesn't, download the latest version of iTunes. The problem will be solved:
1) Re-launch iTunes, with and without your iPod plugged in.
2) With iTunes open, reset your iPod Touch
(here:http://docs.info.apple.com/article.html?artnum=305743 ) Press and hold the Sleep/Wake button and the Home button at the same time for at least ten seconds until the Apple logo appears.
3) Restart your computer leaving your iPod touch plugged in
Note: If you uninstall iTunes from a computer, it will be uninstalled for all the users. But it will show up again for all users once you re-install it again. Before uninstalling each user should backup his/her playlists so they can bring them back when the re-install is completed. No music for any of the users will be removed by iTunes. It will remain intact where it is saved.

2.'I can't turn on my iPod'
I have a 1st or 2nd generation video iPod (80 gig).
My computer is windows 2000 so I downloaded the windows 2000 iTunes. So I decided to update my iPod, it was updated and it was fine. It ran out of power. Then it won't turn on? I tried to charge it but it just keeps saying please wait such and such. I left it there for like 2 hours already, and still it didn't charge up... Is the problem because I updated my iPod or something else? And when I opened my computer, iTunes asked me if I can format my iPod into windows. I put yes, it didnt do anything. So I have to problems, its not charging.. and its not turning on.
by Ashley :'My friend had this same problem a few years ago.She just left it plugged in to her computer for a few days, waited it out... eventually the problem fixed itself on its own. I'd say just wait it out for a day or two, and if it's still having problems, take it in to your nearest Circuit City or something.”
by Karat :'its the most popular iPod problem. If you drain the battery fully, you're screwed. Basically the battery is down, but the darn thing wont charge unless you connect it to the usb and the usb wont detect it unless it has charge! So please take it to your nearest apple outlet.”
by Kylla :'The one thing you never want to do with an iPod is let it run out of power, not good for it at all :P I've done it a few times but try to avoid it. What you want to do is hold the menu button and the play/pause button at the SAME time and just wait for it. It should restart it. Thats how my iPod works, yours could be different so experiment with the buttons. Try holding perhaps the center button and the play/pause button? or center button and the menu button? Try to see which two buttons will restart it, its bound to work. But hold BOTH of them down at the SAME time with one hand..and be patient, wait for about 10-15 seconds or so. :)”

3. Why does my 30G iPod video always die quickly?
Even when I am just listening to music. It shuts off after about 45 min. And that is a problem because I am going on a plane trip soon and I plan to watch a movie on my iPod, but movies eat your batttery. Does this happen to anyone else???? How can I make the battery life last longer. btw, it is only like a year old.
by dipin :'In an iPod the battery life is different.
it doesnt depend on how old it is rather it depends on how many times you have charged and discharged it.
for increasing the battery life you should fully charge the battery every time you are charging it . and secondly you should never let it discharge completely . put it on charging just before it shows the red signal and disconnect it only when it is fully charged.
sorry to say but now u'll have to get the battery replaced from apple reseller if you want to watch complete movie the battery life as said by apple is 500 complete cycles of charging and discharging”
by sugadoll :'The same thing happened to me. The problem is that your computer can't detect a completly dead iPod, but you need the computer to charge it so your screwed. j/k I solved it by pluging it into my ihome dock that plugs into the wall. So if you have a wall iPod dock or a car one you can charge it enough so that the computer can detect it. Problem solved.

How to connect your Mac and Xbox 360

If, like me, you have your Xbox 360 placed near your wifi-enabled computer, but away from your wireless router or modem, then you'll want to take advantage of the Xbox's ability to "borrow" your computer's internet connection. For Windows users, this process is simple; it's just a matter of "bridging" your computer's wifi connection to your PC's internet port which is plugged into your Xbox. For Mac users, the process is not so easy. What follows is a guide for getting your Xbox 360 to accept Mac OS X's internet sharing option.
Before you start configuring, open up Terminal (in Applications -> Utilities) and type "ifconfig en0" (zero, not a capital-o). You're looking for the bit that says "inet xxx.xxx.xxx.xxx". In my case, the number I get here is 192.168.2.1 Second, note down the IP address of your wireless router, which in my case is 192.168.0.1

On your Mac
1. Connect your Mac to your wireless internet connection
2. Connect your Xbox 360 to your Mac via Ethernet
3. In System Preferences -> Sharing, enable Internet Sharing between your Airport and Ethernet connection

On your Xbox 360
1. Start up your Xbox and navigate to the Network settings menu
2. Under IP address, enter the number you got from the "ifconfig en0" command earlier on, but with the final number one place higher. In my case, I take the 192.168.2.1, and input 192.168.2.2 in the IP address box on my Xbox 360.
3. Under subnet, input 255.255.255.0
4. Under router/gateway, enter the number you got earlier from the "ifconfig en0" command. In my case, that's "192.168.2.1"
5. Move onto DNS. Enter the IP address of your wireless router (in my case, "192.168.0.1") in both the primary and secondary IP address fields
6. Leave PPPoE and advanced settings blank (i.e. OFF and Automatic)
7. You should now be able to connect to Xbox Live via your internet sharing Mac

This guide shows the connection of Mac and Xbox 360 is not so difficult. You can try it by yourself.

WWDC 2010: Steve Jobs on the App Store

In response to a question from Walt Mossberg at last week’s D8 conference addressing criticism about the App Store’s rejection rate, CEO Steve Jobs made a point of noting that Apple supports HTML5, a completely open platform, and that the company supports its own App Store, which is a curated platform.

He reiterated that notion in his keynote today:

“Guess what? Ninety-five percent of all apps submitted are approved within seven days.”

“What about the ones we don’t approve? Well why is that? What are the reasons?

1: The app doesn’t do what you said it would.

2: It uses private APIs…and if they change the app will break.

And the third reason? They crash.”

“If you were in our shoes, you’d be rejecting for the same reasons. Even with this, 95 percent are approved in seven days. Sometimes you read these articles and you think something is going on….”
